Waste Audits and Duty of Care Compliance
The Duty of Care Regulations, along with the Hazardous Waste Regulations (2005), are an intrinsic part of the regulatory framework for all waste produced in the United Kingdom. These regulations and the Environmental Protection Act (1990), from which they are derived, form the regulatory framework through which all materials that are defined as wastes should be monitored.
The intention of the regulations is to ensure that all materials are handled correctly and that all persons that:
1. HOLD
2. TRANSFER
3. DISPOSE
of waste materials have written information that enables them to handle the material safely and in such a way that it will not cause harm to the environment or local amenity. It is intrinsic to the Regulations that the producer of the wastes ensure that there is correct documentation in place, that it is used correctly and that the materials are transported using registered Waste Carriers, to a suitable licensed waste management facility. Failure to follow the Regulations can, and in many cases does, end in action taken against the producer and carrier of the waste.
